General Director Kim Oanh Group affirmed that having allocated the land fund for social housing development in accordance with the law, there is no “forgetting” to set aside the land fund for social housing.

For many days, the information that 2 residential projects of Cau Do and My Phuoc 4 residential area (Ben Cat town, Binh Duong) of Thuan Loi Investment and Development Joint Stock Company (a member of Kim Oanh Group) did not spend enough 20% of the project land fund to develop social housing is attracting the attention of the public.

Responding to this information, on June 9, Ms. Dang Thi Kim Oanh, General Director of Kim Oanh Group affirmed that the land fund for social housing development has been allocated in accordance with the law.

According to Mrs. Oanh, in Cau Do residential area (trade name is Mega City urban area), the project has a scale of nearly 50ha invested by Thien Phu Company. According to the approved land use structure, the proportion of land for housing for low-income people accounts for 7% of the total residential land area of the project.

In 2014, Thuan Loi Company successfully auctioned and received the transfer of the project. Receiving the transfer, Thuan Loi Company is responsible for implementing the Cau Do residential area according to the plan approved by the competent authority. 

On 31/5/2017, Thuan Loi Company sent a letter to Binh Duong Department of Construction requesting to maintain the social housing rate of 7% according to Decision 378/QDUBND dated 24/1/2006 of the Provincial People’s Committee.

On 26/6/2017, the People’s Committee of Binh Duong province issued a letter approving Thuan Loi Company to allocate social housing land fund in Cau Do residential area at the rate of 7%, the remaining area is included in the traffic land fund increased compared to the previous plan.

Based on the direction of the People’s Committee of Binh Duong province, the provincial Department of Construction has requested the People’s Committee of Ben Cat town to guide the company to make a dossier of adjustment of the 1/500 master plan, and at the same time agree on the allocation of land fund to build social housing at the rate of 7%-9%, the remaining area is included in traffic land increased compared to the previous plan.

On 6/7/2017, Thuan Loi Company made a written request to adjust the planning of Cau Do residential project. In which, the area of social housing land is 2.28ha, accounting for 9% of the residential land area and adjusted the traffic land area increased from 14.58ha to 18.44ha, an increase of 2.87ha.

“Thus, the total area of social housing land and traffic land increased to 5.15ha, accounting for 20.3% of the total residential land area, ensuring compliance with Official Dispatch 2643/UBND-KTN dated 26/06/2017 of Binh Duong People’s Committee,” said Mrs. Dang Thi Kim Oanh.

On that basis, on 11/7/2017, the People’s Committee of Ben Cat town issued a decision approving the detailed planning plan of the scale (1/500) of Cau Do residential area according to the ratio of social security approved by the Provincial People’s Committee. On 31/12/2021, the People’s Committee of Binh Duong province issued a decision approving the adjustment of the investment policy of the Cau Do residential project, according to which the project has 276 adjacent social housing units.

Golden Center City project.

In My Phuoc 4 residential area (trade name is Golden Center City), the project including 2 areas My Phuoc 4A (Golden A) and My Phuoc 4B (Golden B) was approved for planning in 2003 invested by Thien Phu Company. According to the original plan, the project does not allocate land for social housing, housing for low-income people.

On February 6, 2006, the People’s Committee of Binh Duong province issued a decision approving the detailed planning for adjustment and expansion of My Phuoc 4 residential area, in which, 8.35% of the residential land area is allocated for low-income people. On July 2, 2007, the People’s Committee of Ben Cat district issued a decision approving the detailed planning plan scale 1/2000 adjusting My Phuoc 4 residential area, reducing the proportion of residential land for low-income people to 7.58%.

In 2014, Thuan Loi Company won the auction and received the transfer of the project along with the Cau Do residential area. After Thuan Loi Company took over the project, the People’s Committee of Ben Cat town issued a letter approving the allocation of 8% of the total residential land area as a land fund for social housing and approving the detailed planning plan scale (1/500) of My Phuoc 4 residential area – Zone B, allocate 8% of the residential land area for social housing.

“Thus, Thuan Loi Company has arranged a land fund for social housing development in 2 residential projects of Cau Do and My Phuoc 4 residential area in accordance with the planning approval of the People’s Committee of Binh Duong province”, General Director Kim Oanh Group affirmed.

Previously, the inspectorate of the Ministry of Construction issued Conclusion No. 106/KL-TTr on the implementation of land fund allocation for investment and development of social housing (social housing) and the management and use of funds for maintenance of the common ownership of condominiums in Binh Duong province.

According to the inspection conclusion, the Ministry of Construction determined that some investors of commercial projects in Binh Duong province have not set aside land for the construction of social media according to the Government’s regulations.

Specifically, the report of the People’s Committee of Binh Duong province sent to the Inspectorate of the Ministry of Construction said that in the period of 2016-2021, there are 178 commercial housing projects invested in Binh Duong province, of which 17 projects have to set aside land funds to build social housing, the remaining 161 projects of less than 10 scale have chosen the form of payment to the State develop social housing instead of setting aside land funds.

Among the 17 projects that are required to set aside land fund for social development development, there are 13 projects with a scale of over 10ha, 4 projects with a scale of less than 10ha.

At the time of inspection, the Ministry of Construction found that two projects with a scale of over 10ha did not set aside enough 20% of the project’s land fund for social energy development. These are Cau Do residential project and My Phuoc 4 residential project, area B. Both projects are invested by Thuan Loi Company.

Cau Do residential project, according to the detailed plan scale of 1/500 approved by the People’s Committee of Ben Cat town in 2020, the ratio of land reserved for social housing to the total residential land area is more than 7.5%.

My Phuoc 4 Residential Project, the land area for social housing in 2 zones (A and B) according to the approved plan accounts for more than 8.1% of the residential land area.
